On April 10, the session on the case of the Karelian researcher of the Stalinist repressions Yury Dmitriev continued. The defense has questioned another witness for the prosecution, the court ordered a re-examination of the weapon from the criminal case. This was reported by the correspondent "7x7" from the court.
According to Dmitriyev’s lawyer, Victor Anufriev, the prosecution filed a motion to re-examine the weapon about two months ago, but he asked the police to submit a paper stating that the weapon is in their registry. This weapon is a type IZH-5, which was produced 62 years ago. The could be no originals, but for the examination you need a weapon of the same type in order to understand whether you can shoot with it.
“I asked the court to be allowed to participate in the examination of weapons. The court granted this request. I will be present during the examination,” said Victor Anufriev after the meeting, “Today we also interrogated a witness, a representative of the guardianship authorities.”
The testimony of the witness remains unknown, as the meetings are held in closed session.
The next meeting is scheduled for May 14th.
This is the third examination of the weapon, which was withdrawn from Dmitriev after the arrest. The weapon is an old sawed-off shotgun, which he took from the neighbors' boys. Dmitriev was charged under Part 1 of Article 222 [“Illegal possession of the main part of weapons”] of the Criminal Code. The first examination did not confirm the sawed-off shotgun. Judge Marina Nosova, when she pronounced the sentence on April 5, 2018, sentenced him to 2 years and 6 months of restriction of liberty under this article — taking into account the time that Dmitriev spent in the SIZO, he should have been limited in freedom for three months. For the rest of the articles, Dmitriev was acquitted.
Yury Dmitriev was detained for the first time on December 13, 2016, three days later the court placed him in detention facility of Petrozavodsk on suspicion of producing pornographic pictures of his adopted daughter. In July 2017, Memorial human rights organization recognized Dmitriev as a political prisoner and demanded to stop his criminal prosecution. On January 27, he was released from the SIZO on a written undertaking not to leave the place. On April 5, 2018, Dmitriev was acquitted, but the Supreme Court of Karelia overturned this decision on June 14.
Dmitriev was again detained on June 27, 2018. The investigative committee opened a new criminal case under the article on “sexual assault of a minor”. At the request of lawyer Victor Anufriev, Judge Alexander Merkov combined both cases into one.
